Additionally, our members are sparring partners for companies in the field of learning and development. The NRTO and its members consider it their responsibility to establish norms concerning the behavior of its members. The aim of the NRTO Code of Conduct is thus to contribute to socially responsible business practices and the promotion of expertise and reliability of the members. This code of conduct also applies to subcontractors and partners of NRTO members who provide services on their behalf. The code of conduct serves as a calling card for the industry.<\/p><p><strong>Part 1: General Provisions<\/strong> <strong>Article 1: Definitions<\/strong> This code understands:<\/p><p>a. NRTO: Dutch Council for Training and Education. b. Industry: Natural and legal persons active in the field of learning and development. c. Members: Natural persons, legal persons, and partnerships without legal personality, registered in the Chamber of Commerce, who are engaged in the provision of education, training, and\/or education, supply teaching materials, and\/or offer (part) exams and\/or an EVC procedure or another form of assessment in accordance with legal provisions. d. Employee: Any person who has an employment relationship with an NRTO member. e. Freelancer: Someone who performs assignments for the member as a freelancer or otherwise. f. Client: The natural or legal person on whose behalf the services are provided. This can be either a business or private client. g. Customer: The natural person to whom the service is provided.<\/p><p><strong>Article 2: Principles<\/strong><\/p><ol><li>Members shall comply with the laws and regulations applicable in the Netherlands concerning their employees, customers, and partners.<\/li><li>The behavior of members must, within the objectives of the association, withstand public scrutiny.<\/li><li>Members behave responsibly and with integrity towards the client and customer.<\/li><li>Members refrain from anything that could damage the reputation of the NRTO and its members.<\/li><li>The interests of clients and customers are respected.<\/li><li>Members will uphold the values of free entrepreneurship and fair competition and behave accordingly towards each other.<\/li><li>The actions of employees of the member or a third party performing a task on behalf of the member are also seen as the behavior of the member.<\/li><li>In the conduct of their business, members adhere to the principles of good governance mentioned in part 2 concerning the manner of business operation, clients, customers, and partners, and colleagues in the industry.<\/li><li>In case of doubt about the interpretation of this code, the board or an authorized representative of the board has the deciding vote.<\/li><\/ol><p><strong>Part 2: Five Principles of Good Governance<\/strong> Members of the NRTO are expected to adhere to five principles of good governance: <strong>Article 1: Principle of Diligence<\/strong> Members of the NRTO work carefully, with personnel qualified for the learning activity. Everyone working for the member has the specific expertise required to perform the tasks in accordance with this code and to meet the NRTO quality requirements as formulated in the NRTO quality mark. Members commit themselves to deploy their knowledge, experience, and capacity as effectively as possible for the client and customer. Members of the NRTO avoid, in the relationship with the client, any interests other than those of the task execution itself, in order to guarantee their independent position towards the client. Members do not provide judgments about the client&#8217;s employees from the training and\/or examination process unless the training and\/or examination process also aims to provide a judgment about the participants. In such cases, participants must have been explicitly informed beforehand of the purposes of the respective training and\/or examination process and the standards on which the judgment is based. Members will never have, directly or indirectly, any financial connections or contributions to persons, organizations, businesses, or related (legal) persons who have direct or indirect influence on the awarding of a contract.<\/p><p><strong>Article 2: Principle of Legal Certainty<\/strong> Members have a complaints procedure. As set out in the General Terms and Conditions of the NRTO, there is always an opportunity for a private client to appeal to The Disputes Committee or court (private clients) or the Quality Enforcement Commission (business clients) after the complaint procedure has been completed.<\/p><p><strong>Article 3: Principle of Reasonableness<\/strong> The learning activity must be reasonably proportionate to the requested or described efforts and costs.<\/p><p><strong>Article 4: Principle of Reliability<\/strong> Clients and clients must be able to rely on agreements made with a member being fulfilled.<\/p><p><strong>Article 5: Principle of Transparency<\/strong> Members make clear through an agreement or confirmation what is expected of the member in the specific assignment situation. Members make rates\/costs known to a client and customer in a clear and transparent manner before the assignment. Members are transparent about additional costs. In advance, a member makes known or public which general terms and conditions apply. If a member does not have its own general terms and conditions, the NRTO general terms and conditions apply. If activities of a strategic nature are performed for a competitor of the (potential) client, which might lead to a conflict of interest at the strategic level, the member notifies this (potential) client.<\/p><p><strong>Part 3: Communication<\/strong> The NRTO member respects the advertising code. Advertising provides a truthful image and refrains from any suggestion of unachievable results. The NRTO member does not make advertising statements about awarding non-recognized &#8216;degrees&#8217;. When there is open registration, the NRTO member mentions at least the information listed in the NRTO quality mark checklist in the study guide or information or website, as applicable. The NRTO member is clear in the information provision about each learning activity regarding what the participant learns. The information provided through promotional material, study guides, and on the website must be correct and informative. This also means that, if applicable, the status of the diplomas, certificates, and testimonials, as well as the corresponding examination process, is accurately displayed.<\/p><p><strong>Government-recognized Education<\/strong><\/p><p>When it comes to recognized Higher Education, recognized vocational education, and recognized secondary education, it is expected that the NRTO member will comply with the requirements stated in the relevant law. It must be entirely clear whether a higher education, vocational education, or secondary education program is government-recognized; only then may the terms higher education, vocational education, or secondary education be used. Specifically for higher education, article 7.15 of the Higher Education and Research Act (WHW) and the resulting agreements with the inspection apply concerning information about degree granting. If no application has been submitted, or if the application is still pending, it must not be suggested that it involves a higher education or vocational education program. A member provides such information to students and prospective students about: a. the institution, b. the education to be followed in general terms, c. the differentiation in the range of programs, d. the selection of students, e. the names of the programs, and f. the degrees linked to the programs, enabling these students and prospective students to compare educational opportunities, form a good judgment about the content and structure of the education and exams followed or to be followed, and prepare well for the set requirements. The names of higher education and vocational education programs used in promotional materials are consistent with the corresponding CROHO or CREBO registration.<\/p><p><strong>Part 4: Responsibilities Towards Other NRTO Members<\/strong> The NRTO member behaves responsibly towards other NRTO members. This means, at least:<\/p><p>The member makes written agreements with fellow NRTO entrepreneurs about each other&#8217;s contributions and responsibilities when collaborating on an assignment. If a member can reasonably expect that an assignment from a client, who already employs another member, will lead to a conflict, the member will inform both the client and the other entrepreneur of these expectations. A member does not use or copy products from fellow NRTO entrepreneurs unless written prior permission has been given. This obligation applies to both personnel and freelancers working for the member on a freelance basis. This will be done in accordance with applicable copyright laws. The member will not undertake activities in its recruitment activities for new assignments aimed at denying another entrepreneur the same assignment based on negative qualifications of the other entrepreneur. The member refrains from evaluating the work of another NRTO entrepreneur for the same client unless permission for this has been given after mutual consultation. The leadership of a member is responsible for ensuring that its employees or those working in the field of education under its responsibility comply with these rules of conduct. Members do not initiate an offer to employ a person, employed by a client, in their own or another&#8217;s service, other than after prior consultation with the client. The member lets the interest of the client prevail.<\/p><p><strong>Part 5: Compliance<\/strong><\/p><ol><li>The code of conduct is offered to new members for signature.<\/li><li>In case of non-compliance, a member can be held accountable for his actions at the Quality Enforcement Commission. The commission is authorized to impose the following sanctions: a. Issuing a warning to the concerned member; b. Giving advice to the NRTO board to expel the member.<\/li><li>If this code of conduct does not provide for situations that are considered relevant for the NRTO, its members, and\/or the industry, this will be discussed by the board on the advice of the Quality Enforcement Commission.<\/li><li>If there is a binding rule prescribed by the government, the provisions of that rule take precedence over those of this code of conduct. The NRTO board may amend this code of conduct. The board will consult the Quality Enforcement Commission for advice before amending the code of conduct.
